1. Introduction
These Terms and Conditions govern your use of the NurseFlex platform (nurseflex.co.uk), operated by NurseFlex Ltd (company no. 17153168), a company registered in England and Wales. By accessing or using NurseFlex, you agree to be bound by these Terms.
2. Definitions
- "Platform" refers to the NurseFlex website, dashboards, mobile applications, and all related services.
- "Professional" refers to any healthcare worker registered on NurseFlex.
- "Organisation" refers to any healthcare facility, NHS Trust, care home, or agency registered on NurseFlex.
- "Services" refers to shift matching, compliance management, timesheets, training, and all features provided by NurseFlex.
3. Account Registration
You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. NurseFlex reserves the right to suspend or terminate accounts that contain inaccurate or fraudulent information.
4. Professional Requirements
Nurses and other regulated professionals must hold the registration required for their role. Care assistants and support workers must meet the competence and compliance requirements applicable to their work; professional registration is not required solely because they use NurseFlex. Right-to-work, identity, safeguarding, training and site-specific checks remain necessary as applicable.
5. Organisation Obligations
Organisations must comply with CQC regulations, employment law, and NHS framework requirements where applicable. Organisations are responsible for verifying that booked professionals meet their specific site requirements. Payment terms for completed shifts must be honoured within the agreed timeframes.
6. Shift Bookings & Cancellations
Confirmed assignments are governed by the worker’s agreed engagement terms, assignment confirmation and the provider’s staffing agreement and pricing schedule. Provider cancellation charges and notice periods apply only as agreed in those documents. A provider cancellation charge is not automatically a charge or wage deduction payable by the worker. No-shows and safety concerns are reviewed through the applicable attendance and safeguarding processes.
7. Payments
For direct PAYE staffing, NurseFlex is the employment business and payer. Basic pay, holiday-pay treatment, lawful deductions, payment frequency and payroll particulars are set out in the worker’s Key Information Document and agreed engagement terms. Provider charges, invoicing and payment deadlines are set out in the provider’s agreement and pricing schedule. NurseFlex does not charge workers a fee for finding work. Separately purchased training has its own written price, cancellation and refund terms; purchasing NurseFlex training is not a condition of receiving work-finding services. Relevant existing training from other providers can be submitted for verification.
8. Compliance & Data
NurseFlex handles personal and compliance information as described in its privacy notice and applicable data-protection arrangements. Verification includes the checks applicable to each role and assignment. Expired or incomplete required evidence can prevent booking access. Platform access does not itself confirm clinical competence, right-to-work clearance or provider approval.
9. Intellectual Property
All content, design, logos, and software on the NurseFlex platform are the property of NurseFlex Ltd and are protected by intellectual property laws. Users may not copy, modify, distribute, or reverse-engineer any part of the platform without written permission.
10. Limitation of Liability
NurseFlex provides workforce technology and acts as an employment business and payer for its direct PAYE temporary staffing service. PAYE agency-worker engagement does not by itself establish employee status; the applicable engagement terms and the actual working arrangements determine rights and responsibilities. A separately approved engagement model must be documented before use. These platform terms do not replace the individual worker’s engagement terms, Key Information Document, assignment particulars or the provider’s staffing agreement. Nothing in these terms excludes liability that cannot lawfully be excluded or limits statutory employment or agency-worker rights.
11. Termination
Either party may terminate their account at any time. NurseFlex reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to patient safety. Outstanding payments remain due upon termination.
12. Changes to Terms
NurseFlex Ltd may update these Terms at any time. Users will be notified of material changes via email and platform notification. Continued use of the platform after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
